In normal circumstances the Listing Rules require an issuer to publish a document using ESS. Submission to HKEX via CD-ROM (or any other means) will not satisfy an issuer’s obligations under the Listing Rules. HKEX will only accept e-mail (or any other means as announced by the Exchange from time to time) in contingency circumstances, such as a failure of both ESS and back-up system. In these circumstances HKEX will contact all Authorised Persons to inform them of what contingency measures to take.
In all other circumstances, an issuer must make submission for publication via ESS. An issuer should first ensure that its own systems are not at fault, if necessary, use alternative Internet connections or to appoint an agent to submit on your behalf. It is important for the HKEX to understand from the issuer why a document cannot be submitted via ESS. HKEX will consider the reasons to determine if it should invoke contingency measures.
